Please read these Terms of Service ("Terms") carefully before using the FieldRinoplatform and website at https://www.fieldrino.com (the "Service") operated by FieldRino ("we", "our", or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
FieldRino is a cloud-based field service management platform that provides equipment tracking, work order management, technician scheduling, analytics, and related tools for field service operations. The Service is provided on a subscription basis.
3. Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- One person or legal entity may not maintain more than one free account.
4. Subscription and Billing
4.1 Plans and Pricing
FieldRino offers various subscription plans. Current pricing is available at fieldrino.com/#pricing. We reserve the right to modify pricing with 30 days' notice.
4.2 Payment
Subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely by Stripe. By providing payment information, you authorize us to charge the applicable fees.
4.3 Free Trial
We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.
4.4 Refunds
Subscription fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. If you cancel, you retain access until the end of your current billing period.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to build a competing product
- Scrape, crawl, or extract data from the Service without permission
- Share your account credentials with unauthorized third parties
6. Intellectual Property
6.1 Our IP
The Service, including its design, code, features, and content (excluding user data), is owned by FieldRino and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.
6.2 Your Data
You retain ownership of all data you input into the Service ("User Data"). You grant us a limited license to use your User Data solely to provide and improve the Service. We will not sell your User Data to third parties.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
8. Multi-Tenant Architecture
FieldRino operates as a multi-tenant platform. Your data is logically isolated from other tenants. We implement technical and organizational measures to prevent unauthorized access to your data by other tenants.
9. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our reasonable control (force majeure, third-party outages, etc.).
10. Termination
10.1 By You
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
10.2 By Us
We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in fraudulent activity. We will provide notice where reasonably possible.
10.3 Effect of Termination
Upon termination, your right to use the Service ceases. You may export your data within 30 days of termination. After 30 days, we may delete your data in accordance with our data retention policy.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, FieldRino shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless FieldRino and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Data, or your violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which FieldRino is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
